Welcome to Dawar Network. These Terms and Conditions outline the rules and regulations for the use of Dawar Network’s website, products, and digital services.

By accessing this website, using our software, or engaging our development services, we assume you accept these terms and conditions in full. Do not continue to use Dawar Network’s services if you do not agree to all the terms and conditions stated on this page.

1. Definitions

• “Company”, “We”, “Our”, “Us”: Refers to Dawar Network, an FBR-registered IT and software company based in Pakistan.
• “Client”, “You”, “Your”: Refers to the individual or business entity using our website, purchasing our products, or engaging our IT services.
• “Services”: Refers to custom web and app development, cloud infrastructure deployment, UI/UX design, digital marketing, and automation setup.
• “Products”: Refers to our proprietary platforms, including but not limited to Dawar VPN, Dawar Radio, Dawar Times, and Jalkai AI.

2. Service Agreements & Project Execution

• Scope of Work: All custom development projects will begin with a mutually agreed-upon scope of work or proposal. Any additional features or changes requested outside of the initial scope may incur extra charges and extend the delivery timeline.
• Client Responsibilities: The timely delivery of projects (Speed without compromise) requires active cooperation from the client. Delays in providing necessary content, credentials, or feedback may result in project delays for which Dawar Network is not responsible.
• Support & Maintenance: We provide an agreed-upon period of free technical support after project handover to fix any bugs related to our code. Ongoing maintenance, feature upgrades, or third-party API changes after this period will require a separate maintenance contract.

3. Product-Specific Terms of Use

• Dawar VPN: You agree not to use Dawar VPN for any unlawful purposes, including hacking, spamming, copyright infringement, or accessing illegal materials. We reserve the right to terminate your VPN access immediately without a refund if you violate these terms.
• Jalkai AI & Automation Tools: AI outputs are generated based on algorithms and are provided “as-is”. Dawar Network is not liable for any business decisions, financial losses, or errors resulting from the use of our AI tools or n8n automated workflows.
• Cloud Servers & Web Hosting: We utilize top-tier global data centers to ensure high uptime. However, we are not liable for temporary downtimes caused by hardware failures, network routing issues, or circumstances beyond our control (Force Majeure).

4. Payment, Billing, and Pricing

• Honest Pricing Policy: We believe in absolute transparency. There are no hidden fees. All costs will be clearly outlined in your project proposal or pricing plan.
• Payment Terms: For custom development projects, standard payment terms typically require an upfront deposit before work commences, with the remaining balance tied to specific project milestones.
• Non-Payment: Dawar Network reserves the right to suspend hosting, withhold source code, or take digital products offline if scheduled payments are not made within the agreed timeframe.
• Refund Policy: Due to the nature of digital products and custom software development, payments for completed work are non-refundable. For subscription-based products (like VPN or hosting), refund eligibility will be governed by the specific terms provided at the time of purchase.

5. Intellectual Property Rights

• Custom Development: Upon full and final payment, all intellectual property rights for the custom-developed software, website, or application will be transferred to the Client, unless otherwise specified in the project contract.
• Company IP: Dawar Network retains full ownership of its proprietary products, pre-existing code libraries, and internal AI workflows. Purchasing access to our products (e.g., Dawar VPN) grants you a license to use the service, not ownership of the underlying technology.
• Portfolio Rights: Unless bound by an explicit Non-Disclosure Agreement (NDA), Dawar Network reserves the right to showcase completed projects in our portfolio and marketing materials.

6. Prohibited Activities

When using any of Dawar Network’s platforms or hosting infrastructure, you agree not to:

• Distribute malware, viruses, or malicious code.
• Engage in unauthorized data scraping, mining, or harvesting.
• Host or distribute unlawful, defamatory, or explicit content.
• Attempt to bypass our security measures or perform unauthorized penetration testing on our servers.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Dawar Network shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of our services, or any unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Pakistan.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
